1. The agreement1. O acordo

These Terms of Use are a contract between you and Examer Health ("Examer", "we"). They apply when you download, sign in to or use the Examer Health application and the website at examer.xyz (together, the "Service"). By using the Service you accept these terms. If you do not accept them, do not use the Service. Estes Termos de Uso são um contrato entre você e o Examer Health ("Examer", "nós"). Eles se aplicam quando você baixa, entra ou usa o aplicativo Examer Health e o site examer.xyz (em conjunto, o "Serviço"). Ao usar o Serviço, você aceita estes termos. Se não os aceita, não use o Serviço.

2. Who may use the Service2. Quem pode usar o Serviço

You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. You may add exams belonging to someone in your care if you are legally entitled to handle their health information. The Service organises, extracts and displays information contained in documents you supply. It compares values against the reference ranges printed in your own report. It does not diagnose conditions, does not recommend treatment, does not interpret your results and does not replace consultation with a qualified health professional. Never disregard professional medical advice, or delay seeking it, because of something you saw in the Service. In an emergency, call your local emergency number. Extraction is automated and imperfect. Values may be missed, misread or misattributed. You are responsible for reviewing what the Service extracts against your original document before relying on it for anything. A extração é automatizada e imperfeita. 4. Your account4. Sua conta

You sign in with Sign in with Apple, or another supported provider. Keep your device and your Apple ID secure — anyone with access to them may reach your vault. Tell us promptly if you believe your account has been used without your permission. Você entra com o login da Apple, ou outro provedor suportado. Mantenha seu aparelho e seu Apple ID seguros — quem tiver acesso a eles pode chegar ao seu cofre. Avise-nos logo se acreditar que sua conta foi usada sem sua permissão.

5. Your documents5. Seus documentos

The exams and files you add remain yours. You confirm that you have the right to upload each document you add. You grant us only the limited permission needed to run the Service for you: to transmit the document to our processing service, store it and the values read from it for as long as your account holds them, and return the result to your device. We claim no ownership of your content and use it for no other purpose. You can have the stored copy deleted at any time — see the Privacy Policy. Os exames e arquivos que você adiciona continuam sendo seus. Você confirma que tem o direito de enviar cada documento que adiciona. Você nos concede apenas a permissão limitada necessária para operar o Serviço para você: transmitir o documento ao nosso serviço de processamento, armazená-lo junto dos valores lidos dele enquanto sua conta os mantiver, e devolver o resultado ao seu aparelho. Your vault lives on your device. Keeping backups of your original reports is your responsibility — if you delete the app or lose the device, we cannot restore your data because we do not hold it. Seu cofre fica no seu aparelho. Manter cópias dos seus laudos originais é sua responsabilidade — se você apagar o app ou perder o aparelho, não conseguimos restaurar seus dados porque não os guardamos.

6. Subscriptions and billing6. Assinaturas e cobrança

Part of the Service is free, including reading your first exam. Examer Pro is an auto-renewing subscription, available monthly or yearly, that includes a set number of AI document reads each month. The number included in each plan, and current prices, are shown in the App Store and in the app before you buy, in your local currency. The allowance is monthly and resets every month on the yearly plan too — a yearly subscription does not grant twelve months of reads up front. Using up a month's reads does not lock you out: exams you add after that are still analyzed on your device. Parte do Serviço é gratuita, incluindo a leitura do seu primeiro exame. O Examer Pro é uma assinatura de renovação automática, mensal ou anual, que inclui uma quantidade definida de leituras de documentos com IA por mês. A quantidade incluída em cada plano e os preços atuais aparecem na App Store e no app antes da compra, na sua moeda local. A cota é mensal e renova todo mês também no plano anual — a assinatura anual não concede doze meses de leituras de uma vez. Esgotar as leituras do mês não bloqueia você: os exames adicionados depois continuam sendo analisados no seu aparelho.

• Payment is charged to your Apple ID at confirmation of purchase. O pagamento é cobrado no seu Apple ID na confirmação da compra.
• The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. A assinatura renova automaticamente, a menos que você desative a renovação automática ao menos 24 horas antes do fim do período atual.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price then in effect. A cobrança da renovação ocorre dentro das 24 horas anteriores ao fim do período atual, pelo preço então vigente.

If you are a consumer in Brazil, nothing here limits the rights the Consumer Protection Code (Law 8.078/1990) gives you, including the seven-day right of regret for purchases made outside a physical establishment. We may change prices or the contents of a plan. Changes apply from your next renewal, and we will give you notice before they take effect so you can cancel if you prefer. 7. Acceptable use7. Uso aceitável

You agree not to:Você concorda em não:

• Upload documents you have no right to, or another person's health data without a legal basis. Enviar documentos sobre os quais não tem direito, ou dados de saúde de outra pessoa sem base legal.
• Use the Service to provide clinical services, or present its output as a professional interpretation. Usar o Serviço para prestar serviços clínicos, ou apresentar seu resultado como interpretação profissional.
• Attempt to break, overload, reverse-engineer or gain unauthorised access to the Service or its infrastructure. Tentar quebrar, sobrecarregar, fazer engenharia reversa ou obter acesso não autorizado ao Serviço ou à sua infraestrutura.
• Resell, sublicense or automate access to the Service outside the app. Revender, sublicenciar ou automatizar o acesso ao Serviço fora do app.
• Circumvent usage allowances or billing. Burlar as cotas de uso ou a cobrança.

8. Intellectual property8. Propriedade intelectual

The Service — its software, design, text, graphics and the Examer Health name and logo — is owned by Examer Health and protected by copyright and trade mark law. © 2026 Examer Health. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, for your own non-commercial use. 9. Availability and changes9. Disponibilidade e mudanças

We work to keep the Service available, but we do not promise it will be uninterrupted or error-free. We may add, change or remove features, and we may suspend the Service for maintenance. If we discontinue a paid feature you have subscribed to, we will give reasonable notice. Trabalhamos para manter o Serviço disponível, mas não prometemos que ele será ininterrupto ou livre de erros. Podemos adicionar, alterar ou remover funcionalidades, e podemos suspender o Serviço para manutenção. Se descontinuarmos um recurso pago que você assina, daremos aviso razoável.

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of extracted values. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you — and if you are a consumer, your statutory rights are unaffected. Na máxima extensão permitida pela lei, o Serviço é fornecido "no estado em que se encontra" e "conforme disponível", sem garantias de qualquer tipo, expressas ou implícitas, incluindo adequação a uma finalidade específica e exatidão dos valores extraídos. 11. Limitation of liability11. Limitação de responsabilidade

To the extent permitted by law, Examer Health is not liable for indirect, incidental, special or consequential damages, or for lost data or lost profits, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event giving rise to it. Nothing here excludes liability that cannot lawfully be excluded, including for fraud, wilful misconduct, or death or personal injury caused by negligence. You may stop using the Service at any time and delete your account. We may suspend or end your access if you materially breach these terms, or if we are required to by law. On termination, your licence ends; the sections that by their nature should survive — ownership, disclaimers, liability and governing law — continue to apply. Você pode parar de usar o Serviço a qualquer momento e excluir sua conta. Podemos suspender ou encerrar seu acesso se você violar substancialmente estes termos, ou se a lei nos exigir. These terms are between you and Examer Health only, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app; any support questions go to support@examer.xyz. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Examer Health, not Apple, is responsible for addressing any claim relating to the app, including product liability, legal or regulatory compliance, and consumer protection claims, and for investigating and settling any third-party claim that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Estes termos são apenas entre você e o Examer Health, não com a Apple. 14. Governing law14. Lei aplicável

These terms are governed by the laws of the Federative Republic of Brazil. Disputes are subject to the courts of the city of São Paulo, Brazil — except that, if you are a consumer, you may always bring proceedings in the courts of your own domicile, and mandatory consumer-protection rules where you live continue to apply. Estes termos são regidos pelas leis da República Federativa do Brasil. As controvérsias ficam sujeitas ao foro da comarca de São Paulo, Brasil — exceto que, se você for consumidor, poderá sempre demandar no foro do seu domicílio, e as normas cogentes de proteção ao consumidor do lugar onde você vive continuam aplicáveis.

15. Changes to these terms15. Alterações destes termos

We may update these terms. The date at the top of the page shows the current version, and we will give notice in the app of changes that materially affect you. Continuing to use the Service after a change takes effect means you accept the updated terms. Podemos atualizar estes termos. A data no topo da página indica a versão vigente, e avisaremos no app sobre mudanças que afetem você de forma relevante. Continuar usando o Serviço depois que uma mudança entra em vigor significa que você aceita os termos atualizados.
